U.S. Supreme Court Decides That States Can Seek Reimbursement for Future Medical Expenses from Medicaid Beneficiaries’ Injury Settlements
On June 6, 2022, the U.S. Supreme Court held, in a seven-to-two decision, that the Medicaid statute permits a state to seek reimbursement from settlement payments allocated for future medical care.

5th Circuit Court of Appeals Upholds Provider Fee That States Pay Under the Affordable Care Act (ACA) to Receive Federal Reimbursement for Managed Care Organization (MCO) Payments
On Friday, July 31, 2020, the U.S. Court of Appeals for the Fifth Circuit overturned a lower court decision and upheld the provider fee that states are required to pay under Section 9010 of the ACA, on behalf of MCOs, in order for the states to receive federal reimbursement for payments to the MCOs.

On October 22, 2019, Chief Judge Margaret M. Sweeney held that a class of health insurers were entitled to nearly $1.6 billion from the U.S. government pursuant to a provision of the ACA.
